Mesothelioma Class Action Lawsuits
Filed Under Cancer | Leave a Comment
When people with similar claims join forces to seek monetary compensation through litigation, we talk about a class action lawsuit.
This process can be highly time and cost efficient, for both, the claimants and the courts. Mesothelioma is a fatal disease, and along with asbestosis and certain kinds of lung cancer, is caused by exposure to asbestos particles. A cure is yet to be found and even though the available treatments can help to improve a patient’s quality of life, they are very expensive. I am a cancer patient, too, and so is my wife. Therefore, we know that our unwanted ‘hobby’ cancer can leave a person with a huge bill. But Mesothelioma treatments are on the extreme side and for that reason, filing for a compensation claim might result in the needed financial funding to keep up with the medical expenses. Of course, a mesothelioma patient needs to have the legal grounds before he is eligible to file a claim.
Mesothelioma class action lawsuits are complex and may therefore go on for a long time. Quite frequently we see a whole group of asbestos lawyers or a law firm taking on the litigation for the claimants. Finding the best legal representatives is imperative. They can make sure that the filing process will be handled quickly plus they can help you with the entire administrative burden. If you ever had to deal with completing any kind of legal paper-work, you probably know what I’m talking about. A mesothelioma class action lawsuit needs to be authorized by a judge, who will evaluate the claim, taking into consideration the number of claimants, the scope of the claim and the similarity of the individual cases to validate that everything can be handled in one bundled lawsuit.
Mesothelioma class action lawsuits are not always the best option for an asbestos victim who seeks to get compensated for his pain and suffering. Strategically, it might make more sense to pursue legal action individually as opposed to a group approach. It all depends on the circumstances and this is why the advice of a reputable and accredited mesothelioma lawyer is absolutely crucial. The single most important aspect is to consult with a legal expert as soon as the diagnosis is conclusive, since the statue of limitations sets forth a timeframe in which a claimant has to file his case. Rules and regulations may vary from state to state and jurisdiction.
The first lawsuits against asbestos manufacturers go back to the 1960s. Former workers in the shipbuilding, mining and construction industries, who got sick because their employers either failed to warn or adequately protect them from asbestos exposure, decided to gather their efforts and file one combined class action lawsuit.
Since then, nearly 800,000 asbestos lawsuits have been filed, either through mesothelioma class actions or individual claims.

Mesothelioma Claims For an Asbestos Injury
Filed Under Cancer | Leave a Comment
Mesothelioma is caused when there has been asbestos exposure. It becomes lethal when it is airborne. Inhaling these dust particles overtime in large quantities will give you mesothelioma or asbestosis. If you inhale small quantities for a short period of time you are also at risk. Mesothelioma is most commonly found in the pleura, lungs, peritoneum, abdomen, or pericardial, heart. The most common area is in the lungs. There is currently no known cure for mesothelioma. Over 3,000 people are diagnosed with mesothelioma each year. This number is much larger worldwide. Asbestos is in use all over the world, exposing hundreds of thousand of people to this deadly natural occurring mineral.
The dangers of this mineral were not understood for a very long time. As a result it was used in hundreds of materials during the greatest expanding time in history, the industrial revolution. It is found today in old buildings, railways, and cement. Working with asbestos exposed hundreds of thousands of people to airborne asbestos. It was originally hard to pinpoint where this disease came from because of the latency period. As a result, people who were exposed early in their life could not link the inhaling of asbestos dust to their injury. The latency created twenty and sometimes fifty-year gaps from the period of exposure to diagnosis. This created many challenges in understanding the cause of mesothelioma. It wasn’t until insurance companies stopped insuring people that worked with asbestos that there was a greater understanding of the causes of mesothelioma. This led to further research into the dangers of asbestos.
When the dangers of asbestos were known hundreds of thousands of people who had previously held asbestos jobs came to the forefront of the courtroom to be compensated. Many asbestos companies new the dangers of asbestos and hid medical facts from employees. As a result mesothelioma claims flooded the courtrooms and bankrupted tons of construction, roughing, and mining companies.
Exposure to asbestos did not just affect the people who worked with asbestos but entire families who acquired asbestos related illnesses. Asbestos was often carried home on clothing and was then inhaled by other people. Inhaling even small quantities of asbestos through clothing or dust particles that remain in someone’s hair can be extremely dangerous. People who are most at risk of indirect exposure to asbestos dust are those who washed the clothing of an asbestos worker. Contacting a lawyer who specializes in mesothlioma claims is imperative in receiving fair compensation from working asbestos jobs.

Mesothelioma Cancer Still Affecting People
Filed Under Cancer | Leave a Comment
Mesothelioma is a rare type of cancer that forms in the linings of the chest (the pleura) abdomen (the peritoneum) or heart (pericardium). This cancer is caused by exposure to asbestos. Asbestos is a fibrous incombustible mineral used for fireproofing, electrical insulation, building materials, brake linings, and chemical filters. When this chemical is inhaled, it can be extremely toxic and cause this type of cancer.
Asbestos was widely used especially before mid-1970s in industrial products such as cement, brake and clutches, roof, floor and ceiling tiles, textiles, and insulation.
The people that are most likely to suffer from mesothelioma are those who were exposed to asbestos fibers at work. Since mesothelioma usually has a latency period of 20-50 years where the illness is not apparent, most people with this cancer did not know about it until it was too late. The disease usually appeared many years after having been exposed to asbestos, even if it was only during a short summer job. The jobs that are believed to have been exposed to considerable amounts of asbestos are: workers in asbestos mines and mills, producers of asbestos products, insulators, who are also known as asbestos workers, boilermakers, plumbers, pipefitters and steamfitters, plasterers who worked with fireproofing spray, shipyard and Navy workers, electricians, mechanics, bricklayers, millwrights, carpenters, steel workers, refinery and other industrial workers, maintenance workers, and many others.
There are also other people who have been exposed to asbestos in their homes without even being aware of the danger. There were those people who were family and friends of those who worked with asbestos products. These workers would bring asbestos particles stuck to their clothes, shoes, hair and skin. This is known as household exposure.
However, mesothelioma is still considered as a cancer with a relative small reach. Not everyone who was once exposed to asbestos developed this cancer later on. The figures are still low compared to other types of cancer: about 3,000 new cases are diagnosed in the US every year. Although it seems to affect mostly men, increasing the risks with age, it can appear on anyone at any point in their lives. The asbestos found in finished products in the houses like walls, tiles, and pipes do not pose a threat unless they are damaged or disturbed. It is only this way that the asbestos fibers are released into the air and inhaled or digested which may cause the cancer.
Since Mesothelioma is primarily a personal injury occurring from the work place, those injured should be able to take action against irresponsible businesses that exposed its employees to this cancer-causing material. This disease can actually be completely prevented, since the only known cause is asbestos exposure. This disease not should continue killing people. The horrific effects of asbestos were well-known by companies making good use and big profits out of this material. Many companies even tried to hide the awful truth about the deadly effects of asbestos to its workers and their families. Of course, this was easy because for most cases it took 20 years to be diagnosed.
There are many treatments to combat this cancer such as chemotherapy, surgery and radiation therapy. However, this is one of the deadliest cancers because the time between it is diagnosed and the person dies, averages to less than 6 months. Because of this rapid nature of Mesothelioma, it is imperative to take action against those companies that lied to its workers before it may be too late.

Mesothelioma Symptoms
Filed Under Cancer | Leave a Comment
Mesothelioma is a disease caused by exposure to the asbestos dust. The most unfortunate aspect of this disease is that its symptoms do not appear soon enough or within a short enough time after exposure to the asbestos dust. This complicates matters because when the symptoms finally appear, in most cases, they are not associated with the disease. It takes very long time, sometimes even decades, for the symptoms to appear in form of obdurate cough, shortness of breath and chest pain. Initially, the unsuspecting patient and even his family physician associate these symptoms with common diseases like pneumonia. It is when the disease starts spreading to other organs of the body that the doctors apprehend and tend to trace the origin of the symptoms of this life-threatening condition.
The other symptoms that appear are weight loss, breathing difficulty, fever and difficulty in swallowing food. The voice pattern may also change and the cough may be accompanied by blood; there also may be swelling on the neck and face.
Other symptoms can be in the form of pain in the abdomen, loss of appetite, nausea, palpitation of the heart and vomiting. There may also be anemia and clotting of the blood. The best course of action is that a person should inform the doctor about any regular or inadvertent and short exposure to asbestos dust. Even acute symptoms of mesothelioma may be mistakenly associated with other diseases.
There are, however, some patients who do not show any important symptoms at all. Tumors may develop around the heart and can spread to other parts of the body. As the time passes and the disease grows older, the symptoms of all the three types of Mesothelioma–pleural, peritoneal and pericardial–start appearing in more vigorous form. Even at this stage, the symptoms are likely to be confused with other diseases. It is important not to ignore symptoms that continue to persist over a long time. It is also necessary to know the symptoms of all the three forms of mesothelioma so that the disease can be identified in the nascent stage. The delay in identifying these symptoms may allow the disease to take firm roots in the system, and then it may become too late to treat it.

Pleural Mesothelioma
Filed Under Cancer | Leave a Comment
Pleural Mesothelioma is a cancer of the lungs which is caused due to exposure to asbestos, though the symptoms often only manifest many years after this exposure. It is a deadly disease and in many cases the prognosis is not good.
The Symptoms of Pleural Mesothelioma
Pleural Mesothelioma attacks the lungs and leads to difficulties breathing, chest pains, a persistent cough and pleural effusion. These symptoms usually only occur long after exposure to asbestos and some patients may not show any symptoms.
Its Causes
The causes of it are generally related to the inhalation of asbestos particles which then make their way to the lungs and lead to an attack on the lungs and cancer.
Risk Factors
Unfortunately in the past asbestos was widely used in many different industries and since it was widely used in construction can be found in many homes, schools, universities and other places. People who are particularly at risk however are those who worked in industries that required actually working with these asbestos-containing materials such as in the asbestos-textile industry, shipping, construction, etc.
Mesothelioma Lawsuits
Today many people are taking action against employers who they believe were negligent in allowing them to be at risk of contracting this disease and who are now suffering as a result. A number of people have won considerable amounts, though nothing can compare with the suffering involved.
Pleural Mesothelioma is a cancer that attacks the lungs of people who have been exposed to asbestos. It leads to symptoms such as chest pains, breathing difficulties and pleural effusion though in some cases no symptoms may be present. Today many lawsuits are being decided against employers who may have put their employees at risk of contracting this disease by not taking the necessary precautions.

There are various diseases associated with exposure to asbestos. However, you should know that the most common diseases associated with asbestos start in a person’s lungs. Because of this, there are certain asbestos symptoms you can look for in a person to see if he or she is suffering from an asbestos lung disease.
Shortness of breath – Are you frequently running out of breath? Can’t you even go up one flight of stairs without panting or wheezing? Shortness of breath is frequently a symptom of asbestos illnesses. This is because the asbestos fibers inside your body have irritated your lungs to a point that scar tissue has already formed around the air sacs of your lungs. This means that oxygen can’t travel from one air sac to another. This means that you are processing oxygen very inefficiently.
Because of this, you need to take breaths more frequently. A problem with this asbestos symptom lies in the fact that it increases over time. Let’s say that today you can’t manage to walk for 10 feet without getting shortness of breath. The next day, you won’t even be able to accomplish 5 without stopping. If you experience this asbestos symptom then maybe it’s time to go see a doctor for a thorough examination.
Coughing – Another common asbestos symptom would be coughing. This symptom is triggered by the fact that the small asbestos fibers which accumulate in your lungs do irritate the organ tissue. Because of this, you feel an irritation in every part of your respiratory system. You cough as a reflex action to try and clear your lungs of the asbestos fibers, but it is no use, and you just keep coughing and coughing without actually relieving the irritation. If you experience this, then you might want to get an x-ray to see if there are any asbestos fibers in your lungs. Although a lot of diseases include coughing in their list of common symptoms, exposure to asbestos and a cough should definitely be investigated thoroughly.
An asbestos symptom that could come with coughing would be coughing up blood. Bloody sputum would actually indicate that the irritation of your lungs has gotten to a point that the lungs are actually wounded. This actually happens when the asbestos fibers themselves get moved around and cut into the lungs. When you cough up blood, things are very serious and it is important to find a doctor immediately.
Chest pains – This asbestos symptom is also caused by severe irritation and wounding of the lungs. Although asbestos fibers do cause a lot of damage to the lungs, sometimes, the lungs cause the damage to themselves. This is because the lungs often try to alleviate the irritation automatically using the body’s defense mechanism. However, with asbestos fivers, this has a different effect altogether. With asbestos fibers, the involuntary action of the lungs just causes the tissue to become even more irritated and could sometimes lead to wounding. Since the lungs become even more irritated, this triggers another round of reflexive actions and the cycle goes on and on. This type of asbestos symptom can be the most difficult to deal with as internal pain can be very unbearable.
Increased sputum – If you are experiencing an increase in the amount of your sputum, then you have to realize that this asbestos symptom too is caused by your body’s efforts to alleviate its discomfort. By increasing the production of sputum, your lungs hope to wash away whatever the irritant is. Unfortunately, however, asbestos fibers tend to cling much tighter than that. Because of this, all that results is you having to spit a lot more often.
Weight loss – A sudden drop in weight could be very bad indeed if it is a symptom of asbestos illnesses. This is because sudden weight loss often indicates that the disease may have already spread out to other parts of the body. If a person who has been exposed to asbestos suddenly loses a lot of weight, then you really ought to get him or her to the hospital.
These are just some of the symptoms you should keep an eye out for if ever you have been exposed to asbestos in the past. Remember, however, that some asbestos symptoms only appear when the disease is in its advanced stages so just to be sure, try to get a regular check up.

Mesothelioma and Asbestos Side Effects
Filed Under Cancer | Leave a Comment
In an earlier article, I have elaborated on the possible legal solutions one can consider when handling cases or suffering from mesothelioma or asbestos cancer. In this article, I shall briefly discuss other forms of situations or occasions one maybe exposed to potential side effects, giving cause to such cancer.
We maybe aware that certain occupations will expose particular groups of people to mesothelioma or asbestos poisoning. Generally such cancers occur as a result of constant exposure or inhalation of fine particles of certain asbestos materials. Common trades include those working in the construction and renovation industry, factories supplying asbestos materials to related industries, and so on. Although regulations have already been passed to ban the use of asbestos in most countries, there are still certain states or countries that choose to ignore such regulations, at the risk of their workers’ health. Those that choose to comply have already begun switching to other forms of similar property materials, other than asbestos.
What is mentioned above is of direct concern to those involved in trades that have first hand exposure to asbestos. However, one should also be concerned even if you are only a end user of such materials in your homes of workplace.
As time goes by, any form of material will deteriorate. Wall paint will being to lose its color or peel off, metal fixtures may begin to rust as a result of oxidation, and even plastic items may begin to turn moldy due to temperature variances depending on its intended use. Likewise, users of asbestos products can expect their ceiling boards or wall partitions to deteriorate as well.
While this may appear to be common sense knowledge (now that we look at the behaviour of other materials), there are a surprising number of people out there who aren’t aware of such characteristics! And over the years, those occupants who work or live in such premises utilizing asbestos materials may not even be aware of the daily constant exposure to such deterioration.
Think about it: if such materials are really that safe to handle and work with, why are the workers handling and assembling asbestos boards in your vicinity provided with face masks and gloves. It’s to minimize their exposure during the installation process! If that’s the case, why aren’t end users required to put on face masks when they are surrounded by asbestos material? See the logic?
Having said that, are you provided with the necessary level of protection if your organization is in the construction and renovation trade? Is your company trying to reduce its cost exposure by cutting back on the necessary personal protective equipment?
As discussed above, regardless of which side of the spectrum you are currently at, everyone needs to know the risks and potential exposure involved in asbestos environment. Just remember that at the end of the day, we should not be ignorant of potential resources and avenues available to us in ensuring our personal well being.
Remember this: you owe it to yourself to work and live in a safe and asbestos free environment. And if this is not the case presented to you, you have every option and right to seek the relevant solutions to these mesothelioma and asbestos problems.

Advanced Mesothelioma Symptoms
Filed Under Cancer | Leave a Comment
Mesothelioma symptoms tend to develop gradually, and earlier symptoms are often confused for illnesses that are more amenable to treatment. For example, the cough, difficulty breathing, and chest pain experienced in pleural mesothelioma is often seen in lung infections such as pneumonia. Typically, once symptoms are more pronounced the cancer is fairly advanced and treatment becomes less effective.
In advanced pleural mesothelioma, chest pain and pain under the ribcage may become more pronounced; back pain may also be present. Coughing may be present; blood may also be coughed up. Hoarseness and swelling of the face and arms may be seen. Patients may also experience muscle weakness and sensory loss. In advanced peritoneal mesothelioma, abdominal symptoms become more pronounced. These include a swelling or lump in the abdomen, abdominal distension due to a collection of fluid in the abdominal cavity, abdominal pain, constipation due to bowel obstruction, nausea and vomiting, and appetite loss. If there is a lot of abdominal fluid, breathing may become increasingly difficult. The feet may become swollen. In advanced pericardial mesothelioma, coughing, worsening breathlessness, palpitations and chest pain may be experienced.
In all types of malignant mesothelioma, generalized symptoms such as fever, unexplained weight loss and fatigue are usually present. Patients with advanced mesothelioma are usually offered palliative treatment to reduce the discomfort from their symptoms. Pleural or abdominal fluid collections may be drained, and substances that prevent further formation and collection of fluid may be placed in the pleural or abdominal cavities. Surgery or radiotherapy may reduce some of the obstructive symptoms, and radiotherapy may be used to reduce pain. One or more anti-cancer drugs may also be used. A number of clinical trials are ongoing to find better ways to provide symptomatic relief to people with advanced malignant mesothelioma.

Definition of Mesothelioma Injury
Filed Under Cancer | Leave a Comment
The term ‘mesothelioma injury’ encompasses any kind of personal injury that was induced by exposure to asbestos.
The most commonly recognized expression when we think of asbestos injuries is mesothelioma. This disease is solely linked to unprotected contact with the hazardous material, and usually contracted by the victim through inhalation or ingesting of tiny toxic dust particles that linger in the air of contaminated asbestos sites. The disease has a poor outlook on survival. This is primarily due to the fact that by the time a conclusive diagnosis can be made, the cancer has already spread to an advanced stage. Treatment options are available; however, a cure is yet to be found. Further to that, the medical treatment of mesothelioma is associated with immense costs and therefore frequently not realistically available to victims with limited financial resources.
Lung cancer is another asbestos induced disease. The progression of the illness is very similar to mesothelioma. Signs and symptoms of lung cancer include the shortness of breath, persistent dry cough, chest pain and the loss of appetite which may usually results in a significant decrease in body weight. Smokers are at higher risk of developing a lung cancer that is caused by asbestos.
Asbestosis is not a cancer. It is comparable to a chronic inflammation. The body’s defense mechanism tries to conquer the situation by producing an acidy liquid. However, this has virtually no effect on the problem itself, but causes the build up of scar tissue which consequently hinders the lungs from performing normally.
Pleural plaques is another term that is often being used when we talk about an asbestos or mesothelioma injury. They are benign, however it was proven that patients that were diagnosed with pleural plaques are at a higher risk of eventually developing asbestosis, lung cancer or mesothelioma. The disease is described as a form of fibrosis that occurs in the parietal pleura, a thin lining that is connected to the chest wall.
All of the aforementioned diseases and conditions have usually a rather long latency period, and it is not uncommon that we see patients exhibiting the first symptoms 40 years later after they were initially exposed to asbestos. Anyone who has or had an occupation that brought him into contact with the material is strongly advised to consult with a health care professional. The same applies to homeowners who are concerned of living in an environment where asbestos products were used during the construction process of their homes.

Mesothelioma is caused from inhaling asbestos fibres, it is material and cause cancer. This is common, including construction workers, including long-term exposure to asbestos. It also can cause asbestos in the buildings organisms isolated for a long period of time, and genetics play an important role, some people are more susceptible than others.
This type of cancer is relatively rare, involving the skin, an organization that line body. Secretion of this organization, to the device’s motion. Mesothelioma, cancer often affects the lungs, stomach, heart and other organs.
Unfortunately, mesothelioma is a serious disease, with high mortality rates. If the tumor is malignant, survival is not optimistic. The average survival time after diagnosis is about a year. However, if the firm is the treatment of cancer, as well as whether the patient is an opportunity to live in at least two years, the survival rate after five years is improving.
One of the most common diseases, mesothelioma lung membrane Pacific, which occupied chest. In these cases, the asbestos fibers to travel photography, the lining surrounding the lungs hurt cells, leading to cancer. A slow start, and the most common symptom is pain in the chest sustained. Other forms of mesothelioma is peritoneal mesothelioma (which appeared in the abdomen) and pericardial mesothelioma), which affects the heart).
Mesothelioma is a general trend, the question is tens of thousands of asbestos claims. Many people are willing to come forward and seek compensation for this lawasuits medical expenses, lost wages, pain and suffering, and so on.
