Bankruptcy/Child Support?

My fiance has a son from his ex girlfriend. He pays her $312 a month. Which he thinks is a little low and can afford a little more. This amount was decided less than 2yrs ago in court. He’s never missed a payment.. comes from his check and everything. He sees his son quite often (even though nothing is in writing bc they agreed to not have to go to court and just have a verbal agreement between them)
As of I believe Sept of last year, she has been in the process of filing for bankruptcy. It just went through about a month ago when she had her court date.Well last year around the same time…we got an order for a readjustment hearing. He submitted all the paperwork he needed to (neither one needed to be present) and it doesnt look like she submitted all hers. on the order… it states his son’s name as HER LAST NAME not his! which is not the case at all! So she’s painting the picture that he’s not around and that he’s a dead beat dad. Also not the case. Him and I are having our own child due in 6wks.. and he is in no way shape or form a dead beat dad or man!
We got the paperwork back from the hearing with their new “suggestions” it’s $789.00/month! How does it almost triple he hasnt changed jobs or had a drastic pay increase but she has changed jobs and makes MORE money than she used to (still less than him though) Would this have ANYTHING to do with her filing bankruptcy? We have a lawyer bc we’re appealing it, and he meets with him on Thursday… and now she has to either get a lawyer or represent herself (they will not appoint one to her)
has anyone else been in a similar situation or can shed some knowledge? I’m completely clueless on his rights and what not. Thanks!

I filed bankruptcy about a year ago and I pay 200 to the trustees which is even a lot. well i just got notifivation that the trustees now want 470 a month! My lawyer said she truied to get them down and she did her best she said. I even just went to meeting to get it lowered but the trusteess wouldnt lower it! do the trustess have a right to do this? I really feel my lawyer should have done more! I am barely making it and I dotn know how i will with the higher trusteee pmts? what can i do to get the pmts lowered ? Please reply ASAP!!! I posted a negative review about a company. now their lawyer is harassing me. What are my options?

I am a consumer and I spoke up sharply and negatively about a company that is indeed ripping off others. My “review” circulated across the net… and in fact many agreed with me.
Three weeks ago I started receiving emails from their lawyer threatening legal action. Everytime they come across my article or statements on a blog or in a discussion (not on my sites), I get another “formal notice” email (”govern yourself accordingly”).
It’s to the point where I’m starting to think going to court might be the best option… sueing them for harassment. While I may have posted a negative review, I am a consumer and entitled to freedome of speech. I don’t know why I’m in such a hot seat and I’m getting sick of it.
What’s the worst I could face if sued? Possibly bankruptcy?
Does anyone know what my options are? How far could this go?
By the way, the company in question is operating a money scam… if taken to court, I think that company would be out of “business”. Suggestions?

bankruptcy advice please?

my husband and i are going to meet with my brother today to try and help him out of a huge hole. quick overview: he is $$ and was diagnosed with MS approx 4 years ago. he is now on totla disability. i know he very recently talked to a lawyer about filing bankruptcy, but the $500 retainer check he wrote to him…bounced. yeah, his mind is pretty bad and he simply cant manage many aspects of his life anymore.
anyway, he has agreed to give us legal power of attorney over his finaces, so we can pay his bills. we wont know the credit card totals until later today, but i am assuming its in the tens of thousands. his disability income is approx $1055 a month, so you can imagine, its a tough situation. how important is restoring his credit if his health will continue to go downhill, and he will eventually be in a nursing home?
should we even get power of attorney if he will be filing bankruptcy? could that effect us somehow?

no we as a family love him, but will not take care of his debts. as i said, his mind is not right and last week he went out and charged a brand new tread mill on a credit card…the guy can hardly walk. he can also be verrrry stubborn, and when we get there today, he may very well have forgotten that he agreed to get help. and he has been know to become , well…lets say, very difficult. we will help him, but we wont bail him out.im sorry if that sounds callous, its just our stand on it.
