The law is often described as being an area where there are a lot of black and white situations. The truth is this is rarely the case. One such issue arises with an asbestos-Mesothelioma lawsuit which faces the possibility of being a wrongful death action.
Asbestos is a miracle material. It is extremely heat resistant, which makes it a perfect insulator wherever heat is an issue. From the 1940s through the 1970s, this meant it was used heavily in everything from naval ships to roofing shingles to insulation in schools to the brake pads on your car. There was only one small little problem. It turns out breathing in asbestos fibers can lead to asbestosis [scarring of the lungs], lung cancer or Mesothelioma.
The classic Mesothelioma case is one where the plaintiff argues that they have picked up the cancer because they worked in an area where they were exposed to asbestos. The claims against manufacturers of the asbestos would be based on the legal theory of product liability. Claims against the companies that hired the employees, however, would more often be based on negligence or willful misconduct. Both theories could be brought in the same lawsuit and, in most areas, must be.
A legal issue that often arises is whether the action can be considered a wrongful death lawsuit. The issue arises because Mesothelioma is a very hard form of cancer to diagnose. This means that it usually is only discovered at a very late stage, one in which the patient may not have much time to live. In such a situation, the idea of filing a lawsuit is often the last thing on the mind of family members and things drag out. Once filed, however, the victim may ultimately expire during the case.
So, what happens? The courts in most jurisdictions tend to view the issue as splitting hairs. While they each handle it a bit differently, what is clear is the lawsuit is allowed to proceed and, if proven, the estate or surviving members of the family are allowed too recover against the defendants. Put another way, the defendants are not able to escape responsibility simply because the victim dies.

How to Deal With a Mesothelioma Lawsuit
Filed Under Cancer | Leave a Comment
A mesothelioma lawsuit is a legal claim filed by a victim seeking justice for all the medical bills, loss of an income, pain and suffering they experienced throughout the ordeal. There are many mesothelioma lawsuits that continue to be filed by people who were exposed to the substance called asbestos in their working experience. Firstly, mesothelioma is a cancer that is caused by the exposure to a natural mineral referred to as asbestos and it is used in industries to make so many products and in fact, over 3,000 products can be made from the substance. The companies that hire workers have a moral responsibility to inform and protect workers from such hazards and when they fail to do so, they definitely have a case to answer.
The disease is quite unique and you can have the exposure to asbestos and stay for over 30 years before the disease develops. Therefore, people who were exposed in the 60s and 70s find themselves suffering form it and hence the need to file a mesothelioma lawsuit. The people who are at risk to getting this disease are the ones who work closely with the substance and this can be in asbestos mines, building industry, household appliances industry, ship making industries and the list goes on. They are constantly inhaling the product and it is trapped in their lungs and sometimes swallowed. Its very strong fibers make it hard for it to be expelled from the body and the victim will not realize this until it is too late.
The workers will also risk exposing their families if they carry particles of the substance on their cloths. After there was the realization that the substance was harmful in the late 60s, more caution was taken and workers were informed and advised on the best way to avert the danger. In the United States, there were restrictions put in place and there is an amount of asbestos that is supposed to be exposed to the workers and, before they go home, they make sure that they have taken a shower and changed their cloths. Mesothelioma is known to affect the mesothelial lining which covers the lungs, heart and abdomen. It enables abnormal multiplication of cells which is also known as cancer. The disease can be very fatal especially when it has spread to many area of the body.
A mesothelioma lawsuit is therefore very vital and it may not totally ease your pain but, it will see to it that your medical bills are paid and that you do not have to worry about providing for your family. The first thing you do if you wish to file a mesothelioma lawsuit is to make sure that you have the presence of the disease confirmed by a qualified doctor. Then, you need the services of a good mesothelioma lawyer who will shed light into your rights and how you will go about starting the process. You should not waste a lot of time because in some states, there is a laid out time period when you are supposed to file your case. Your lawyer will give you all the details about the law in your state. Therefore, you need to find an attorney who you can confidently place your case on their able hands.

Mesothelioma Settlements Today
Filed Under Cancer | Leave a Comment
Since there is no real gauge for measuring the damage that a case of mesothelioma can cause a patient or his family, the amount given as mesothelioma settlements today, differs vastly from one case to another, and also from one state to another, depending upon their legislations and amendments.
However, the main factor that determines the settlement money, apart from the damage that mesothelioma has caused a patient, is the state, region and the political atmosphere under which the mesothelioma settlement has reached. During the 80s and 90s, when a lot of lawsuits were being filed and the damaged caused by mesothelioma gauged, the political climate in most of the U.S. was immensely favourable to patients.
However, the overall political climate seems to have undergone a slight change. An example can be given of a reform bill in Texas, which makes neutral medical tests for asbestos related diseases compulsory and another in the state of Georgia, where the onus is on the plaintiff to provide all possible evidence to show that the problem was indeed caused by asbestos.
These were reform bills signed in the mid 90s, after there was a lot of controversy over mesothelioma lawsuits being misused by both lawyers and patients for exaggerated claims. There, however, is no problem when it comes to genuine cases of mesothelioma.
The settlement amount also varies. In the south, it is believed that most mesothelioma settlements cross a figure of one million. However, there can be no generalisations made on the settlement money, since each settlement is dependent on the merits of the case itself and do not lend to generalisations.
The settlements can range from a few thousands of dollars to millions of dollars. There is no average amount for a mesothelioma settlement. There have even been cases of mass settlements, where people allegedly ended up getting just a few dollars individually. The final decision depends totally on the legitimacy of the accusations of negligence in the part of the defendant and the damage caused to the plaintiff. Since courts have a tradition of referring to previous settlements, the settlement could also depend, to an extent, on the results of other such settlements and trial decision in the rest of the country.

Mesothelioma is sometimes referred to asbestos cancer. It is referred to this because the merely known cause of Mesothelioma is exposure to asbestos. Asbestos exposure leads to Mesothelioma in various ways depending on the sort of the malignancy.
Mesothelioma is an aggressive cancer but could be managed with chemotherapy, radiation therapy, and surgery. At present, there is no known cure for asbestos cancer but some mesothelioma treatment regimens have demonstrated to be successful in assisting the patient avoid pain and distress caused by the disease.
A number of therapies have emerged in recent years that have extended survival rates to levels formerly thought to be hopeless. Cancer centers have instructed hundreds of clinical trials in recent years to assist mesothelioma patients get a therapy that runs for them while still working towards a cure for future patients.
Asbestos has also been related to cancers of the lung, as opposed to the pleural lining of the lungs. These are probable the result of malfunction caused due the exposure and inhalation of asbestos fibers, which could also lead to chronic respiratory conditions like asbestosis.
For lung cancer, the treatments are more complex, but all focus around patient comfort and quality of life. For asbestosis, one of the most effectual treatments is in-home oxygen use, which makes sure that the patient gets appropriate oxygen flow despite reduced lung function.
Though asbestos has been regulated for 20 years, mesothelioma lawsuits are still being filed now because of the long incubation phase of the disease. The cancer commonly requires 20-50 years between exposure and the manifestation of symptoms, indicating that a lot of workers who handled asbestos during the height of its use are simply just beginning to show symptoms.
Unhappily, the numbers of lawsuits are only expected to increase. Asbestos cancer is disastrous, and has been terrible throughout history. But nowadays we could fight back against the companies that failed to care for us, and we could appreciate that the world is safer for our children.

Mesothelioma Treatment: A Guide
Filed Under Cancer | Leave a Comment
Mesothelioma is a malignant tumor of the mesothelium caused by exposure to asbestos fibers. Because mesothelioma is very hard to control and is known for its late onset of symptoms, the U.S. National Cancer Institute (NCI) is sponsoring clinical trials that are used to find new treatments and efficient ways to use current treatments.
The most popular method is radiation therapy, also called radiotherapy, which involves using high-energy rays to kill cancer cells and shrink tumors. Radiotherapy affects only the treated area during the treatment. The radiation may come from a machine that produces radiation through thin plastic tubes into the area where the cancer cells are found.
A common treatment for the disease is surgery that involves the removal of part of the lining of the chest or abdomen and some of the tissue around it. In case of pleural cancer, a lung may be removed in an operation called a pneumonectomy. In few cases, a part of the diaphragm, the muscle below the lungs that helps with breathing, is also removed.
Anti-cancer drugs are used to kill these malignant cells throughout the body. This is known as chemotherapy and involves injecting the drug into a vein (intravenous or IV). Currently, doctors are also studying the effectiveness of putting chemotherapy directly into the chest or abdomen.
There are various procedures that are used for the treatment of mesothelioma. Generally, the treatment type depends on the location of the cancer, the stage of the disease, the patient’s age, and general health. Pleural effusion that is caused by heart failure or infection can usually be resolved by directing treatment, however, when testing has realized no diagnosis and fluid continues to build or recur, doctors may recommend chest tube drainage and chemical pleurodesis. Chemical pleurodesis is a technique in which a sclerosing agent is used in treatment. It is used to abrade the pleural surfaces producing an adhesion between the parietal and visceral pleurae, which prevents from further effusion by eliminating the space in pleura. Talc is considered the most effective agent for pleurodesis.

Have you heard about the term mesothelioma? You rarely hear of this word but this is more commonly known as asbestos cancer. If you are suffering from this malignant disease, you surely had anything to do with inhaling dust particles from asbestos, a mineral that’s more identified for its use in buildings and construction. Industries and companies have already been warned for ages about the dangers that the use of asbestos can bring to people’s lives but this didn’t stop them from using this mineral because they are allowed to use this at certain minimal limits. Any miscalculation, misuse or abuse can certainly send their workers to their death beds. This is why it is important to file an asbestos mesothelioma lawsuit against these companies because it is their responsibility to protect their workers against health hazards.
A mesothelioma lawyer is an expert when it comes to filing an asbestos mesothelioma lawsuit. Legally, this lawyer can go after the companies that allow the presence of asbestos in the work place without any safety measures. Filing that lawsuit and getting a final verdict in your favor are the duties of the mesothelioma lawyer. It is important to get a specialty lawyer because most companies will try not to take any responsibility for their actions and getting an ordinary lawyer will only delay the legal proceedings as well as your asbestos claim. Getting asbestos cancer is no joke especially when you have to watch yourself struggle from this disease for the longest time. Dealing with the pain and the medical expenses that come along with contracting this type of cancer is already a burden in itself. This burden is even extended further to your loved ones who are also terrified at your ordeal and feeling your pain.
If more people are filing that asbestos mesothelioma lawsuit and actually win their cases, it can send a message to companies get their acts together to find other alternatives to asbestos. We all have the right to live free from the perils of getting this type of cancer that is not even caused by genetics. It is caused by self-less people who have selfish motives. These companies gain from other people’s losses. They are enjoying their lives while the cancer patients watch themselves getting closer to death each day.
Like many other types of cancer, it is sad to know that there is still no cure for mesothelioma. You are lucky if at any given point in time the medical researchers can come up with a cure for it, that if you are still alive. You can hope for some miracle performed on you but you know you just have to deal with it until your body will become too tired to fight against it.
Someone has to pay for the medical plight you are in. It helps to consult an asbestos lawyer about this. Asbestos lawyers usually will not charge you anything at the beginning of the asbestos mesothelioma lawsuit. If they win the case, that’s the time that they will take a portion of your claim as their legal fees. In fact, even if you die before a verdict has been served in your favor, your surviving family can still benefit from it–like a blood money. Even though no amount of money can compensate for the life that was lost, in one way or another, it can certainly help them move on.

Mesothelioma Can Mimic Heart Disease
Filed Under Cancer | Leave a Comment
Doctors don’t always come up with the right diagnosis. If they make up their mind that a condition is X, it’s hard for them to think about other explanations–sometimes even in the face of evidence that contradicts their initial idea.
Diseases of the chest and the lining of the chest cavity (the peritoneum) can be very hard to diagnose. In one study a woman was found to have an artery blocked. Doctors assumed a heart condition, even though 3 months earlier she’d had fluid drained from her chest–one very important sign of mesothelioma. Doctors then performed a surgical procedure that removed the membrane surrounding the woman’s heart, hoping this would give her some relief. At that point, when they examined the cells they’d removed, they finally reached a correct diagnosis that she was suffering from mesothelioma in the lining of her heart (pericardial).
Normally a biopsy is the best way to diagnose mesothelioma, but malignant mesothelioma cells can look like other kinds of cancer. Tumor tissue that’s removed during biopsy must be submitted to special laboratory tests and, if necessary, examined with an electron microscope to confirm a diagnosis of mesothelioma. The important part is to have a physician who considers all the possibilities when you describe your symptoms.
If you know someone who has ever been exposed to asbestos fibers at work or elsewhere, and they suspect they may be having a heart problem, do them a favor. Help them find a physician who knows about all of the various symptoms that asbestos-related diseases can cause. Mesothelioma is a terrible disease, but with proper treatment some patients are able to gain extra time with loved ones.

This is a very painful and costly illness. The settlement can help ease the burden brought about the disease by helping patients with their treatment and other medical fees. It will also provide the families left behind by mesothelioma victims with financial security. Victims of this disease can turn to specialized mesothelioma lawyers to claim due compensation for their suffering by filing a lawsuit against the asbestos company that caused their disease.
There are two types of mesothelioma lawsuits. The first is the personal injury lawsuit where the victim, or the person diagnosed with the disease, is living and files the lawsuit himself. The second is the wrongful death lawsuit wherein the spouse or the family of the person who passed away due to the illness files the lawsuit and represent the diseased.
Mesothelioma cases generally take a year to be completed, and it takes a couple of months, sometimes a number of years, for the company to pay the settlement after the amount is agreed on by both sides. But when the company declares bankruptcy, the plaintiff, unfortunately, gets nothing. But the figure is encouraging. There is am overwhelming number of documented successful cases against asbestos manufacturing companies. The settlement amount paid by companies ranges from a hundred thousand to a couple of million dollars.
One example of the many successful mesothelioma lawsuits is the case of Caldo vs. John Crane, Inc. (2005, San Francisco Superior Court, Case No. 412325)
Mr. Caldo was a navy mechanist and an engineering officer exposed to asbestos made by John Crane, Inc. Mr. Caldo was responsible for removing and installing pump and valve packing and gaskets during his naval career. All through his working years, Mr. Caldo was exposed with airborne asbestos from the thermal insulation, packing, and gaskets in the engine rooms of ships. At 60, he was diagnosed with Pleural mesothelioma. He filed a case against the manufacturer, John Crane, Inc. and the jury returned a verdict of $8.6 million in his favor. This settlement amount enabled him to live comfortably the remaining days of his life. Although the disease eventually took his life, he was able to secure the future of his family.
Another successful mesothelioma lawsuit was filed by Mr. Hoeffer against Rockwell Automation. (2003, San Francisco Superior Court, Case No. 28817)
As an electrician for most his life, Mr. Hoeffer was constantly exposed with asbestos contained in the electrical equipment he worked with. After he was diagnosed with Pleural mesothelioma, he filed a lawsuit against Rockwell for its defective products and negligence. The company held out from agreeing on a settlement. In the end, the jury awarded $2,999,543 to the 74 year old retired electrician.
